Agreement to Terms

By purchasing, accessing, or using any Evolve product (including the Budget Tracker 2026, Habit Tracker 2026, or the Complete Bundle), you agree to be bound by these Terms of Service. If you do not agree, do not complete your purchase or use the product.

These Terms apply to all users worldwide, including customers in the United States, European Union, Australia, the Middle East, and India. Where local consumer law grants you additional rights that cannot be excluded, these Terms do not limit those rights.

Products & Access

Evolve sells digital web application products. Upon successful payment, you will receive access to your purchased tracker(s) via a personal web dashboard account. Access is granted to the individual purchaser only and is non-transferable.

  • All purchases are one-time payments — there are no recurring charges or subscriptions.
  • Access is tied to your account. You are responsible for keeping your login credentials secure.
  • Evolve reserves the right to modify, update, or improve the product at any time without prior notice. Updates that improve functionality will be provided at no additional charge.
  • We do not guarantee perpetual availability of the product but will make reasonable efforts to maintain access.

Pricing & Payment

All prices are listed in USD. You are responsible for any applicable taxes, currency conversion fees, or charges imposed by your bank or payment provider.

Current pricing: Budget Tracker — $15  |  Habit Tracker — $15  |  Complete Bundle — $25. Prices are subject to change; the price at the time of your purchase is the price you pay.

Payment is processed by third-party payment providers. Evolve does not store your card details. By completing a purchase, you authorise the charge to your nominated payment method.

Refund Policy

Because our products are digital goods delivered immediately upon purchase, all sales are final — with one clearly defined exception.

No refunds will be issued for change of mind, accidental purchase, incompatibility with your device or browser beyond our control, or failure to use the product.

The one exception — Bug-Related Refund: If the tracker you purchased contains a material bug that substantially prevents you from using its core functionality, you may be eligible for a refund, subject to the following process:

1
Report within 7 days
Contact us at scalenevolve@gmail.com within 7 calendar days of your purchase date. Describe the bug clearly, including steps to reproduce it and any screenshots or screen recordings.
2
We investigate & attempt a fix
Once we receive and verify your report, we will work to fix the bug within 48–72 hours. We will keep you informed of progress via email.
3
Refund if we cannot fix it
If we are unable to resolve the bug within the 48–72 hour window and the issue remains unresolved, we will issue a full refund to your original payment method. Refunds typically appear within 5–10 business days depending on your bank.

Refund requests submitted after 7 days, or for issues that do not constitute a material bug (e.g. cosmetic preferences, minor display variations across browsers, or features not advertised), will not be eligible.

Intellectual Property

All Evolve products — including the application code, design, branding, and content — are the intellectual property of Evolve. Your purchase grants you a limited, non-exclusive, non-transferable licence to use the product for your personal or internal business purposes.

  • You may not resell, redistribute, sublicense, copy, or reverse-engineer any Evolve product.
  • You may not use Evolve branding, trademarks, or product screenshots for commercial purposes without written permission.
  • Sharing account access with others is not permitted under a single-user licence.

Limitation of Liability

To the maximum extent permitted by applicable law, Evolve and its team members shall not be liable for any:

  • Loss of data, revenue, profits, or business opportunities arising from use of, or inability to use, our products.
  • Indirect, incidental, special, consequential, or punitive damages of any kind.
  • Failures, interruptions, or delays in service caused by third-party providers (hosting, payment processors, internet infrastructure).
  • Errors in financial figures, calculations, or data you enter into the tracker — you remain responsible for verifying your own financial information.
  • Loss or corruption of your account data due to circumstances beyond our reasonable control.

Our total liability to you in connection with any claim arising from these Terms or your use of our products shall not exceed the amount you paid for the product in question.

Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law. We aim to resolve all disputes amicably — please contact us first before pursuing any formal claim.

Where you are a consumer located in the European Union, you may be entitled to additional protections under EU consumer law, including the right to refer disputes to your local consumer authority or the EU Online Dispute Resolution platform at ec.europa.eu/odr.

Where you are a consumer located in Australia, nothing in these Terms excludes your rights under the Australian Consumer Law, including guarantees that cannot be excluded by contract.

Where you are a consumer located in India, you may have rights under the Consumer Protection Act, 2019 and applicable IT regulations.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our products after changes are posted constitutes your acceptance of the revised Terms.

This policy applies to all users of Evolve products and this website, regardless of your location — including users in the United States, European Union, Australia, the Middle East, and India.

Data We Collect

We collect only the minimum information necessary to provide you with the product and support:

  • Technical data: Browser type, device type, approximate location (country/region), and basic analytics to help us improve the product.
  • Communications: Emails or messages you send to our support address.

We do not collect sensitive personal data such as government IDs, biometric data, or health information.

How We Use Your Data

  • To send you important service updates (not marketing, unless you opt in).
  • To improve product functionality based on aggregated, anonymised usage data.
  • To comply with applicable legal obligations.

We do not sell your personal data to third parties. We do not use your data for targeted advertising.

Legal Bases for Processing (EU / UK Users)

If you are located in the European Union or United Kingdom, we process your personal data on the following legal bases under GDPR:

  • Contract performance: Processing necessary to fulfil your purchase and provide product access.
  • Legitimate interests: Improving our products, preventing fraud, and maintaining security.
  • Legal obligation: Where processing is required by law.
  • Consent: For optional communications such as product updates or newsletters, where you have opted in.

Data Sharing & Third Parties

We share your data only where necessary:

  • Payment processors: To handle your transaction securely. They operate under their own privacy policies and are bound by payment industry standards (PCI-DSS).
  • Hosting and infrastructure providers: Who store your account data on our behalf, under strict data processing agreements.
  • Legal authorities: Where required by applicable law, court order, or to protect the rights and safety of Evolve or others.

We do not share your data with advertisers, data brokers, or any third party for commercial purposes.

International Data Transfers

Evolve operates globally and your data may be processed in countries outside your own. Where data is transferred outside the European Economic Area, we ensure appropriate safeguards are in place — such as Standard Contractual Clauses — to protect your information in line with GDPR requirements.

Your Rights

Depending on where you are located, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Ask us to correct inaccurate or incomplete data.
  • Deletion: Request that we delete your personal data ("right to be forgotten"), subject to legal obligations.
  • Restriction: Ask us to restrict processing of your data in certain circumstances.
  • Portability: Receive your data in a structured, machine-readable format (EU/UK users).
  • Objection: Object to processing based on legitimate interests.
  • Withdraw consent: Where processing is based on consent, you may withdraw it at any time.

To exercise any of these rights, contact us at the email below. We will respond within 30 days. EU users may also lodge a complaint with their local data protection authority.

Australian users: You may contact the Office of the Australian Information Commissioner (OAIC) if you have unresolved privacy concerns. Indian users: Your rights are governed by the Digital Personal Data Protection Act, 2023 and applicable IT regulations.

Data Retention

We retain your account and purchase data for as long as your account is active, or as needed to provide the product and comply with legal obligations (e.g. tax records). If you close your account, we will delete or anonymise your personal data within a reasonable period, except where retention is required by law.

Security

We implement reasonable technical and organisational measures to protect your data against unauthorised access, loss, or disclosure. However, no system is perfectly secure — if you believe your account has been compromised, contact us immediately.

Cookies

We use essential cookies to keep you logged in and maintain your session. We may also use anonymised analytics cookies to understand how users interact with our product. We do not use third-party advertising cookies.

You can control cookies through your browser settings. Disabling essential cookies may affect your ability to access your account.
